Acceptable Use Policy

MadHatter is an independent project. It is not affiliated with, endorsed by, or connected to Higgsfield, Luma AI, ByteDance/Seedance, Google, OpenAI, or any other model provider. These documents are provided for general information only and do not constitute legal advice.

This Acceptable Use Policy (“AUP”) applies to everything you create, upload, generate or share with MadHatter. It forms part of our Terms of Service. We built MadHatter for creative work — these rules exist to keep the platform safe, lawful and trustworthy. Violations can lead to content removal, feature restrictions, account suspension or termination, and — where the law requires — reports to authorities.

1. Absolute Prohibitions (Zero Tolerance)

These result in immediate termination and, where applicable, reports to law enforcement and child-safety authorities:

  • Child safety. Any sexual, sexualized, exploitative or abusive depiction of minors — real, fictional, stylized or AI-generated — including attempts to generate such content, grooming, or content based on a real minor’s face, likeness or voice.
  • Non-consensual intimate imagery (NCII). Creating or sharing intimate or sexually explicit imagery of any real person without their explicit consent, including “nudifying” or sexualizing images of real people.
  • Terrorism and violent extremism. Content that promotes, glorifies, incites or provides material support for terrorism or violent extremist organizations.

2. Real People, Likeness and Deepfakes

  • Do not upload or generate content using the image, likeness or voice of a real, identifiable person without their consent. When you upload a photo, video or audio of another person, you confirm you have their permission.
  • Do not impersonate any person or organization, or misrepresent your affiliation.
  • Synthetic-media disclosure: if an Output realistically depicts a real person, or could reasonably be mistaken for an authentic recording of real people, places or events, you must clearly disclose that it is AI-generated when you share it. This mirrors Article 50 of the EU AI Act, which applies to deepfake content.
  • Do not remove, hide or alter AI-content labels, watermarks or provenance metadata that MadHatter attaches to Outputs.
  • Do not use the Service or Outputs for facial recognition, biometric identification or surveillance of individuals.

3. Deception, Misinformation and Elections

  • Do not create or share content intended to deceive, defraud or scam.
  • Do not generate verifiably false content presented as fact in ways likely to cause harm, including fabricated emergencies, fabricated statements by real people, or manipulated depictions of real events.
  • Do not create content designed to interfere with or undermine elections or democratic processes, including fake political endorsements, fabricated ballots or voting misinformation.

4. Sexual Content

  • No pornographic or sexually explicit content.
  • No sexual content involving minors under any circumstances (see Section 1).
  • Artistic, medical or educational depictions of nudity may be permitted within in-product guidelines, but never involving real identifiable persons without consent and never for minors.

5. Violence, Hate and Harassment

  • No content that incites, glorifies or threatens violence against people or animals, or provides instructions for serious harm (weapons of mass destruction, explosives, etc.).
  • No gratuitous gore (e.g. realistic dismemberment, torture) outside clearly fictional/artistic contexts permitted by in-product guidelines.
  • No hate content: content that dehumanizes, demeans or promotes discrimination or violence against people based on race, ethnicity, national origin, religion, disability, disease, age, sexual orientation, gender or gender identity, including hate symbols and hateful stereotypes.
  • No harassment, bullying, doxxing or defamation of any person.
  • No content that promotes self-harm, suicide or eating disorders.

6. Intellectual Property and Privacy of Others

  • Do not upload Inputs or use Outputs in ways that infringe copyright, trademark, design, personality or privacy rights. You are responsible for having the rights to everything you upload.
  • Do not deliberately generate content that reproduces copyrighted characters, artworks or logos, or content intended to imitate the distinctive style of an identifiable living artist for commercial exploitation without authorization.
  • Do not upload other people’s personal data (including biometric or health data) without a lawful basis.

Rightsholders can report infringement via our notice-and-action procedure (hello@madhatter.technology); affected users can appeal removals within 6 months (see Terms of Service §8). Repeat infringers will be terminated.

7. Illegal and Regulated Uses

  • No use of the Service for any illegal activity, or to promote illegal products or services.
  • Do not present Outputs as professional advice (medical, legal, financial) or use the Service to provide such advice, including medical-result interpretation.
  • No use in high-risk contexts where failure could cause death, injury or severe damage (e.g. operation of critical infrastructure, medical devices, weapons systems).

8. Platform Integrity

  • No scraping, crawling, bulk downloading, or automated mass generation beyond documented API limits.
  • Do not use the Service or its Outputs to develop, train, fine-tune, distill or evaluate competing AI models.
  • No reverse engineering, model extraction, prompt-injection attacks, malware distribution, or circumvention of usage limits, safety filters or moderation systems.
  • No account sharing, resale of access, spam, or artificial engagement.

9. Enforcement and Appeals

  • We use a combination of automated systems and human review to detect violations. Automated filters may block prompts or generations; wrongful blocks can be reported in-product.
  • Depending on severity and history, enforcement ranges from content removal and warnings to feature restrictions, suspension or termination. Except in zero-tolerance and legally mandated cases, we will tell you which rule was violated and why (statement of reasons) and give you an opportunity to respond.
  • Appeals: you can appeal any enforcement decision within 6 months via our in-app appeals form (or hello@madhatter.technology). Appeals are reviewed by a human who was not involved in the original decision. This complaint-handling system is provided in line with the EU Digital Services Act.
  • We report child sexual abuse material and imminent threats to life to the competent authorities.

10. Reporting

Anyone can report content or behavior that violates this AUP via the in-product report button or hello@madhatter.technology. We prioritize reports of illegal content and child-safety issues. Where you report as a “trusted flagger” under the DSA, your reports receive priority handling.
